01 What is being provided

Call answering for calls that are missed, busy, or received outside your stated business hours, plus, on the relevant tiers, management of one or more advertising channels. The system does not take over your main line during business hours and does not place outbound calls to your customers.

02 Setup fee

The setup fee is charged once, before work begins, and covers configuration, panel calendar setup, call routing (a SIP trunk to your existing line or a new number), and test calls. It is non-refundable after the system goes live, subject to the service-level remedy below.

03 Monthly fee and minutes

The monthly fee is billed in advance and includes the minute allowance stated in your written agreement. Overage is billed at the rate set out in that agreement. An automatic notice is sent at 80% of the allowance. Robocalls, silent calls, and voicemail-drops are not counted against the allowance and are not billed.

04 Storm clause

When the National Weather Service declares a storm event affecting your service area, the minute cap is suspended for seven days and overage during that period is billed at cost plus 20%.

05 Advertising spend

Advertising budget is not included in any fee. It is charged by the advertising platform directly to your payment method, in an advertising account owned by you. We never process advertising spend through our own accounts.

06 Service level

Answer rate of 98% or better; lead delivery within 60 seconds of call end; two-hour response and eight-hour resolution for critical faults during stated business hours; one business day for normal requests. We do not guarantee any number of booked appointments or won jobs, as those depend on factors outside our control.

07 Remedy

If we cannot bring your system live and meeting the service level within 30 days of the setup fee being paid, the setup fee is refunded in full. After day 30, the sole remedy for a service-level failure is service credit. Cash refunds are not offered after go-live.

08 Term and cancellation

The first 90 days are month-to-month with no commitment. Either party may cancel with 30 days written notice at any time. An optional annual term at a discount may be offered on day 90; it is never automatic.

09 Your phone number

Your business phone number is registered in your name from the first day and remains yours. Nothing in this agreement transfers ownership or control of it to us.

10 Continuity

If we are unable to provide service for 30 consecutive days, all prompts, knowledge base content, and system configuration built for your business transfer to you on request, at no charge.

11 Your data

Call recordings, transcripts, and intake data collected on your behalf belong to you. You may request a full export at any time. On termination, we retain data only for the periods set out in the Privacy Policy, or delete it sooner on written request.

12 What the system will not discuss

The system is configured not to discuss insurance claims, deductibles, or claim handling, and to respond to those topics only with a statement that your team will follow up. This restriction is a condition of service and is not removable on request.

13 Limitation of liability

Our total liability for any claim arising from this agreement is limited to the fees you paid in the three months preceding the claim. We are not liable for lost profits, lost business, or missed opportunities arising from service interruption, third-party provider outage, or telecommunications failure.

14 Governing law

These terms are governed by the laws of the State of Texas, United States.
